Welcome to 3rd Space Social! These Terms of Service (“Terms”) govern your access to and use of the services, events, and website provided by 3rd Space Social. Whenever you see the word “3rd Space Social,” “we,” “our,” or “us,” it refers to 3rd Space Social Inc.

Services Defined: The “Services” include:

  • Our website, including https://3rdspace.social/ (the “Site”) and other websites that link to these Terms;
  • Our web app (the “Web App”), mobile app (the “Mobile App”), and the related content, platform, services, products, and other functions we offer on or through our Services, including the surveys used to place you on our waitlist, match you with people and places, and reconnect you with those you enjoyed.

Before using our Services, please read these Terms carefully. By accessing or using any of these Services, you agree to be bound by these Terms, whether or not you are a registered user of our Services. You also acknowledge that you have read and understood how your personal information will be collected, used, and shared, as set forth in our Privacy Policy. We reserve the right to modify these Terms and will provide notice of these changes as described below. These Terms apply to all visitors, users, and others who access our Services (collectively, “Users”).

1. Acceptance of Terms

By accessing our services, you agree to be legally bound by these Terms. If you do not agree to these Terms, you may not use our services.

2. Eligibility

You must be at least 18 years of age to participate in 3rd Space Social events or use our services. By using our services, you represent and warrant that you are at least 18 years old.

3. Account Changes or Termination

When creating your Account, you must provide accurate and complete information, and you must keep this information up to date. You are solely responsible for the activity that occurs through your Account, email, phone number, or other credentials (collectively, your “Credentials”).

You can delete your Account whenever you want by contacting us (information below).

We reserve the right to terminate or suspend your access to our services at any time for any reason, including but not limited to a violation of these Terms.

4. Communication

When you sign up, you’ll be asked to provide your phone number and email. By providing your phone number, you expressly consent and agree that we can contact you at that phone number or email address, including by manual dialing, sending email messages, leaving pre-recorded or artificial voice messages, sending or using an automatic dialing system (a) to call or to send text messages to that phone number as necessary to provide our Services or enforce these Terms, our policies, or applicable law, and (b) to send text messages to that phone number notifying you of changes or updates to features of our Services or your Account – even if the phone number you give us is registered on any federal or state Do-Not-Call registry.

We need to be able to make these kinds of calls, send you these kinds of text messages, and disperse email messages to provide our Services. If you decide you’re not okay with that, no problem – just contact us and we’ll delete your Account. For purposes of clarity, the calls, text messages, and email messages described in this paragraph are transactional, not promotional.

You certify that any phone number(s) and email address(es) you provide to us are true and accurate and that you are authorized to enroll such phone number(s) to receive calls and text messages as described above. Additionally, you consent to receive SMS and email messages from 3rd Space to provide updates on your participation. Message frequency depends on your activity. You may opt-out by texting “STOP” or clicking on the “unsubscribe” link in the email message received. Message and data rates apply. We are not responsible for any delays upon sending or receiving text messages.

5. User Responsibilities

  • Respectful Behavior: Participants must treat all other attendees and partners with respect. Harassment, discrimination, and any form of inappropriate behavior will not be tolerated and may result in immediate removal from events and our services.
  • Participation Guidelines: You agree to read and follow any rules and policies we make available to you, including any third-party venue rules for the events you attend. You will arrive at events on time and adhere to any instructions provided by experience facilitators. Failure to follow guidelines may result in exclusion from future events.
  • Will not Impersonate Another Person: You agree to not impersonate another person or misrepresent your affiliation with a person or entity, hide or attempt to hide your identity, or otherwise use our Services for any invasive or fraudulent purpose.

6. Event Participation

3rd Space Social hosts various in-person experiences. By participating, you acknowledge and agree to the following:

  • Assumption of Risk: You acknowledge that participation in our events involves risks, and you assume full responsibility for any risks of injury or harm. 3rd Space Social is not liable for any personal injury or damage to property.
  • Alcohol Consumption: If alcohol is available at any event, participants who choose to consume alcohol do so at their own discretion and are responsible for their actions. We encourage responsible drinking.

7. Cancellation and Refunds

  • Event Cancellations by 3rd Space: If 3rd Space Social cancels an event, you will be eligible for a full refund of any fees paid for that event.
  • Participant Cancellations: If you cancel your participation in an event, refunds are subject to our cancellation policy, which will be stated at the time of booking. In the case of any subscriptions, there will be no refunds provided unless stated otherwise.

8. Intellectual Property

All content on our website, marketing materials, and services—including but not limited to logos, designs, and text—is the property of 3rd Space Social. You may not reproduce, distribute, or create derivative works from any part of our content without prior written consent.

9. Use of Image and Content

By attending 3rd Space Social events, you grant us permission to capture and use your name, likeness, voice, and any materials you share during the events for promotional purposes. We may publish photos and videos from events across various media channels without paying you a fee or royalty. We may make copies of and store your User Content. Additionally, we may modify your User Content, for example so that your User Content can be displayed on our Services.

We want to ensure a positive and safe user experience, and we can (in our sole discretion) delete your User Content or terminate or suspend your Account if we need to in order to comply with laws or remove harmful or objectionable content, or for any other reason. If you wish to have any of your content removed, please contact us using the contact information below.

10. Privacy

11. Limitation of Liability

To the fullest extent permitted by applicable law, 3rd Space Social, our affiliates, partners, suppliers, or licensors (or our or their employees, contractors, agents, officers, or directors) are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to damages for loss of profits, goodwill, use, or data.

To the fullest extent allowed by law, we are not liable or responsible for any of the following:

  • (A) personal injury or property damage of any kind resulting from your use of our service;
  • (B) unauthorized access to or use of our secure servers and any personal information stored on them;
  • (C) interruptions or disruptions in the transmission of our service;
  • (D) bugs, viruses, Trojan horses, or similar issues that may be transmitted through our service by third parties;
  • (E) any errors, inaccuracies, or omissions in content, or any loss or damage resulting from the use of our service; and/or
  • (F) your data or the defamatory, offensive, or illegal actions of any third party.

12. Changes to These Terms

You’re responsible for your interactions with other Users on our Services – not us. We might (in our sole discretion) choose to help, but we’re not obligated to monitor interactions between Users or resolve any disputes or other issues. Things change. We may, with or without prior notice—and without any liability to you—change our Services; stop providing our Services (or features of our Services), to you or to Users generally; or create usage limits for our Services. We may also permanently or temporarily terminate or suspend your access to your Account and/or our Services with or without notice, for any reason, including if (in our sole determination) you violate these Terms, or for no reason.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law principles.

14. Miscellaneous

Only these Terms govern your use of our Services and our relationship with each other. If any portion of these terms is invalid, the rest of these Terms will still be valid and enforceable. If we waive our right to enforce any part of these Terms, that does not mean that we cannot enforce that part in the future. Similarly, if we do not enforce any part of these Terms, that does not mean we cannot enforce that part now or in the future.
